1. Information about us and how to contact us 

1.1   Who we are: We are Ciné Schools and we are a company registered in England and Wales. Our company registration number is 13595253 and our registered office is at 10 Metropolitan House, Pump House Crescent, Brentford, London, TW8 0HA. 

 

1.2   These are the terms and conditions on which we provide Ciné Schools Film Club, Film Academy, Studios and Film Camps and supply services to you.  All customers are expected to be aware of and comply with the terms and conditions set out below.

 

1.3  Please note that the agreement is between you and Ciné Schools. 

 

1.4  Please read these terms and conditions carefully. These terms and conditions tell you who we are, how we will provide services to you, how you may change or end the contract, what to do if there is a problem and other important information.

 

1.5  How to contact us. You can find the contact details online at https://www.cineschools.com/contact

 

1.6  How we may contact you. We may contact you by telephone or by writing to you at the email address or postal address you provided to us when you booked. In some cases, we may use SMS as a means of communication.

 

1.7   “In Writing” includes emails, postal letters or in the form of SMS messages. When we use the words “writing” or “written” in these terms, this takes into account any form of written communication. 

 

2. What we do and the services we provide 

2.1  Film Academy – Ciné Schools provides after school film clubs to schools for children aged between 8 and 18. These clubs are hosted on the partner school's premises and run outside the school day. The ten sessions for each term are designed to provide the framework, support and equipment for the children enrolled to make a short film. However, circumstances beyond our control, such as the reduction in number of sessions in a term by the school, absenteeism, change in location or timing can impact the final production and in extreme circumstances a complete film may not be completed. Ciné Schools cannot make any guarantees on the rate of progress of a learner, charges apply to the activities and do not relate to any attainment outcomes.

 

2.2  Film Studios – Ciné Schools provides holiday camps for children aged between 8 and 11, where experienced film makers and educators will provide the framework, support and equipment for the children enrolled to make a short film over the duration of the Studio.

 

2.3 Experiences and Events – from time to time, Ciné Schools may run local events that are ticketed or open to the public. 

3. Fees – General Terms

3.1  Ciné Schools currently asks its customers to pay for Academies and Studios in full before the Academy or Studio starts.

3.1.1 Payment in full: full payment is applied at the point of booking to confirm each place. Payment by instalments can be arranged by getting in touch with the Ciné Schools office. Any registrations of interest for holiday camp programmes remain provisional until full payment is received and places may be lost if others pay prior to a registration of interest being paid for in full.

 

3.2 Once your booking is in place you will receive a confirmation email detailing what you have booked at which point a contract will come into existence between you and Ciné Schools.

 

3.3  All bookings should be made via the Ciné Schools online booking system, which can be found at https://www.cineschools.com/. Payments must be made either via the booking system (for card payments) or via the account details provided by your local Ciné Schools office. We do not currently take Childcare Vouchers for part or whole payment of Academies, Studios and services provided by Ciné Schools. 

3.4 Participation in Academy and Studio programmes is subject to age restrictions, as stated in the description of the Club or Camp on our and / or the school’s website and information materials. Should you wish to enrol a child outside the age group stated please contact the Ciné Schools office. 

 

4. Course Fees and Payment 

4.1  Course fees

4.1.1 Fees for Ciné Schools Academies and Studios may vary from location to location, depending on local factors such as operating costs. For specific details of course fees, please refer to the Ciné Schools website (https://www.cineschools.com/) or check with your local Ciné Schools office. 

 4.1.2 All course fees must be paid in full in advance of the start date of an Academy or Studio. 

 4.1.3 Payment can on be made via debit/credit card via the Ciné Schools website (https://www.cineschools.com/) as well as by PayPal through the same site. We do not currently take Childcare Vouchers/Childcare Schemes in payment for Ciné Schools Academies or Studios. 

 4.1.4 Students may not be allowed to participate in any activities until the relevant fees have been paid. 

 4.2   Academy or Studio fees apply to the full duration of any Academy or Studio. Individual classes, days or sessions as part of a complete Academy course are not available and fees are not applicable on a pro rata basis. Where any dates or classes of an individual Club or Camp are missed for any reason, past the date of enrolment, there will be no refund due. Where a class, day or session is cancelled out of necessity by Ciné Schools, the class will be rescheduled, or a partial credit may be offered. Film Studio sessions/days may be booked individually where the product description specifies this is available.

4.2.1 Where a host school cancels or causes a session to be unworkable and provides this information in good time (at least four weeks ahead), all attempts will be made by Ciné Schools to ensure that time is made up, within the term, to as best as possible provide the necessary time and resource to complete the planned production. Should individual children not be able to join these rescheduled or extended sessions, there will be no refund due. 

5. Film Academy

5.1 Film Academy is a Filmmaking certification programme provided by Ciné Schools, supported by and with accreditation provided by the British Film Institute (BFI).

5.2 Qualifications are worked for by students over the course of the three terms of an Academic year. Each term provides different elements to be completed to achieve the Primary Certificate in Filmmaking. Individuals can start any of the three terms but all three terms must be completed and each individuals performance signed off by the course leads for certificates to be awarded. Should a child start their path to an Understanding Filmmaking certificate in a term other than the Autumn term, they can complete the course by continuing into the following academic year.

5.3 Specific class dates will be scheduled in co-operation with the host school. There will be equivalent to 30 classes per year or 10 classes per term, unless restricted by local school holiday dates. In the case of school holiday dates restricting the number of sessions per term to fewer than 10, the sessions will be tailored to ensure the planned film production can be completed. 

5.3.1 Should a child miss a number of sessions, this does not necessarily mean that they will be unable to achieve the Primary Certificate in Filmmaking, however it may impact their ability to cover all the elements required to be signed off. 5.4 Film Club trial or taster sessions may be offered at the suggestion of host schools.

5.4.1. Trial classes are subject to availability and availability is not guaranteed. For instance if a Club is fully booked, then we may be unable to offer a trial class. 

5.4.2 Trial sessions are available to new students only and only available for the first or second session of the term. Trial sessions are organised directly by the host school and Ciné Schools does not offer these directly to customers.


6. General Terms

6.1  Your rights to change your mind

 6.1.1 In accordance with the Consumer Contract Regulations 2013 you have the right to change your mind where you have purchased goods or services online.  Under these regulations, you have 14 days after the day we email you to confirm we have accepted your order during which you can change your mind and get a full refund of any monies paid to us.  To do so please contact us by email or telephone and we will arrange for the cancellation and refund of any payments made.

6.1.2 Where an Academy or Studio begins within 14 days of the date of your booking and your place is taken up, all charges will apply. 

6.1.3 We will refund the amount you paid to us by the method you used for payment. We will make any refunds due to you as soon as possible and, in any event, within 14 days of you telling us you wish to exercise your right to change your mind.
 

7. Cancellations and Refunds

7.1   All cancellations requested by a customer are subject to an administration charge of £10.00. This applies to each booking cancelled. 

 

7.2  Any booking may be cancelled by customers and eligible for a full refund by providing not less than 7 days notice prior to the commencement of the Academy or Studio. Notice of cancellation should be provided in writing and a full refund, minus the cancellation charge, will be issued using the original method of payment.

 

7.3 Any booking which is cancelled with fewer than 7 days written notice of the course start date is subject to the full course fee being charged. 

 

7.4  Once an Academy or Studio has commenced, no refunds will apply in the event of non-attendance. In this instance, a credit or transfer may be offered as an alternative. This is at the discretion of Ciné Schools. 

 

7.5   Method of cancellation

  1. To cancel a booking, customers should provide notice in writing direct to Ciné Schools office using the contact details available at https://www.cineschools.com/contact orby email the bookings team at: bookings@cineschools.com 

  2. Notice of cancellation must be provided in writing, ie. by email. Messages left on an answer phone or voicemail is not considered satisfactory notice.

  3. Working hours apply. If notice is received after 5pm, it will be considered to have arrived the following working day. If notice is received over a weekend, it will be considered to have arrived the following Monday. 

  4. If notice is sent via postal services, it will apply from the date of receipt, not the date of issue. 

7.6 Cancellation, Rescheduling or Amendments to Particulars made by Ciné Schools

7.6.1 In the unlikely event that Ciné Schools or a host school needs to cancel a Academy or Studio, you will be informed in writing at the earliest possible opportunity. 

7.6.2 Where Ciné Schools or a host school may need to cancel any Academy or Studio out of necessity, we will attempt to reschedule classes/activities or offer alternative course options where appropriate. Ciné Schools will provide substitute sessions where possible either at an alternative time and/or venue.  

7.6.3 If no alternative can be offered, Ciné Schools will provide refunds for Academies or Studios that are unable to be fulfilled. This excludes any courses or programmes that are impacted by local legislation, for instance, any courses impacted by measures connected to Covid-19 or force majeure events. In this event, programmes will be rescheduled to future dates authorised by the relevant local authorities. 

7.6.4 Where Ciné Schools or a host school has to cancel or amend an activity, we will give as much notice as possible. You will be notified by email, text message, and by telephone call at the first opportunity. Parents/guardians are responsible for checking their voicemails. 

7.6.5 We reserve the right to make changes to any advertised courses in the event of illness or other circumstances beyond our control. This may include changes to the venue, dates, programme content etc, within reason. This will only take place where absolutely necessary and we will always try to provide as much notice as possible. We will do our best to keep class times, programme delivery formats and/or locations as similar as possible and within a reasonable travelling distance of the original activity. 

8.  Medical Details, Access Support, Learning or Additional Support Needs (collectively ASN)

8.1 Details of any known Medical, Access or Additional Support Needs (collectively referred to as ASN) is essential for the safe running of our Academies or Studios and for reference in emergency situations.  It is the responsibility of the parent/guardian or person placing the booking to supply up to date, relevant ASN information and to update whenever there are any changes.

 

8.2 ASN details can be updated at any time by providing details to your local Ciné Schools office. 

 

8.3 Ciné Schools will not be liable in any way should details have been completed inaccurately or incompletely.

 

8.4 Ciné Schools keeps all such records securely and only accessible by specified individuals within the organisation. All information obtained will be held in accordance with all relevant data protection laws as are in force and in place from time to time, as well as in accordance with our own Privacy Policy, copies of which are available at www.cineschools.com

 

9. Personal Possessions 

9.1 Ciné Schools will not accept liability for the loss of or damage to any personal effects brought to Academies or Studios by a student to any session and you are therefore requested to ensure that no valuable items are brought to Ciné Schools activities. 

9.1.1 At the suggestion of individual children, some items may be brought from home to be used as part of costumes or as props. These items are brought at the own risk of the child and as such parents and guardians should consider if any such items are to be brought to a Academy or Studio. Ciné Schools will not accept liability for the loss of or damage to any such items brought in for such purposes. Ciné Schools staff will advise individual children suggesting items be brought along as to whether they should and that they should seek permission form parents or guardians to do so.

 

9.2 In the event that a student brings their own equipment to a Ciné Schools activity, the student holds responsibility for this equipment and should not permit other students to use it. Ciné Schools cannot verify the suitability of any personal equipment and is not responsible for any loss or damage or injury sustained whilst any personal equipment is in use by a student. 

 

9.3 The use of mobile phones during activities is not permitted. These should be hidden from view, in pockets or bags.

 

9.4 Ciné Schools will not include or involve any representatives in investigations relating to personal property, outside of compliance and cooperation with organisations such as the police or the local authority.

 

10.  Attendance, Drop-Off & Collection 

10.1 Students should aim to attend as many sessions within their Academy or Studio as possible. Academy or Studio dates will be as advertised, or as communicated to customers in course communications by Ciné Schools and/or the partner school. 

 

10.2 Where a student misses a session due to absence, Ciné Schools cannot guarantee to offer catch up support. 

 

10.3 Where a student is absent, it is possible that any specific roles or responsibilities allocated to them as part of the filmmaking process may be recast or reallocated owing to the necessary production schedules. 

 

10.4 Academies are held after school and children once dismissed by a member of school staff should make their way directly to the Academy location. 

10.4.1 Parents and guardians should notify Ciné Schools by email if their child is absent from school on an Academy day. Ciné Schools team will check absentees with the school office.

10.4.2 Children attending Academies at school should be collected promptly at the session end time. Should individuals have permission to leave school independently, this needs to be confirmed when booking or in writing to the Ciné Schools office team for children to be allowed to go home alone. Children will only be allowed to go home alone in line with school policy, should schools not allow this, Ciné Schools will also require a parent, guardian or known adult to collect the child after Film Academy.

 

10.5 Holiday Film Studio days start and end at the advertised times. Parents or guardians are responsible for all students outside of advertised class times. Students should not arrive more than 15 minutes prior to the commencement of their activity. 

 

10.6 If running late for collection, the parent or guardian should notify a Ciné Schools representative at the earliest possible opportunity and advise of a likely time of arrival. 

10.6.1 A mobile phone number that will be on and available to a parent/guardian must be provided when booking and should a child be still waiting for collection 15 minutes after the session end time, that number will be called and if necessary a voice message recorded. Ciné Schools staff reserve the right to alter the collection point at the venue should the child be collected more than 15 minutes after the session end time. Details will be communicated by phone, voice mail and other written channels available to confirm details. 

10.6.2 Late collection: in accordance with our Safeguarding Policy, if a student has still not been collected by an appropriate adult, and no alternative option has been put in place by the parent or guardian (and communicated to the Ciné Schools staff on site) by 60 minutes beyond the session end time, the student will be transferred to the nearest police station. You will be notified in writing and should arrange to collect your child from the police station. In such an event, a charge of £75.00 will be applied in order to cover staff expenses. Charges may be charged automatically, using any payment method held on file. All other terms outlined in our Safeguarding Policy will apply. 

 

10.7 Booking contacts should remain contactable for the duration of the session or activity (and after the scheduled finish time) or provide details for a suitable alternative person to contact in the event of an emergency. 

 

10.8 Ciné Schools Film students, parents, guardians, siblings or all other associates, must observe any rules in operation at the location or venue of the classes, particularly with respect to health and safety. These rules will be signposted or communicated by other means. In the event of any non-compliance, or where behaviour may jeopardise the health and safety of others, Ciné Schools staff or venue staff retain the right to refuse admission. In such circumstances, Ciné Schools will not be liable for, or offer, any refunds or credits for any missed sessions.

11.  Ciné Schools Staff

11.1 Ciné Schools only works with staff who have current Enhanced DBS Disclosure from England and Wales, Disclosure Scotland and Access Northern Ireland. Ciné Schools instructors are also subject to additional vetting checks to ensure their suitability to work with children. 

 

11.2 Ciné Schools will endeavour to ensure consistency of staffing week-to-week or day-to-day, however, it is likely that cover staffing will be required on occasion. Ciné Schools reserves the right to appoint cover staff to its classes at any time as required by the operational circumstances.  

 

11.3 If you have any concerns as to the conduct or suitability of a member of Ciné Schools staff, please contact the Ciné Schools office who will discuss the matter with you and attempt to address any concerns you may have.
 

12.  Behaviour

12.1 Children are expected to follow the conduct and expectations outlined in the Ciné Schools Behaviour Policy at all times. 

 

12.2 Staff are responsible for implementing the Behaviour Policy and may contact parents in the event of any behavioural concerns. Parents should familiarise themselves with the Behaviour Policy prior to students taking part.  

 

12.3 In the event of a student, parent, guardian, sibling or other associate failing to act in accordance with the Behaviour Policy, refusing to comply with an instruction from a member of staff, or behaving in an unruly manner towards a member of staff, a student, or any other person or causing damage to premises, or any of the furniture fixtures or equipment in those premises, the student’s membership to sessions may be terminated. 

 

12.4 In such circumstances as outlined in 12.3, Ciné Schools will have the right to terminate the contract and the student shall not be accepted for any future course organised by Ciné Schools. Ciné Schools will refund any charges paid for courses not started following termination of membership.
 

13.  Condition of Premises

13.1 Ciné Schools will make all reasonable efforts to ensure that the condition of its hired premises are in suitable condition for its intended purposes. Ciné Schools does not accept liability for any injury to a student that may be caused by any defect which is beyond our control, however we will cooperate and facilitate any relevant communication with all parties in the event of any incident or concerns. 

 

13.2 If you have any concerns or comments regarding the condition of the premises, please let the instructor know and we will attempt to resolve any issues as quickly as possible. 

14. Transmission of Infections

14.1 It is the responsibility of each student, or their parent or guardian to ensure that the student is fit and well enough to participate.  Ciné Schools will not accept liability for any infection passed to a student by another student taking part in its activities. 

 

14.2 In the event of any national guidance related to the spread of infections, customers should follow UK Government advice. Ciné Schools will act in accordance with local legislation at all times and will follow the most up-to-date government guidelines to ensure safety standards are met. 

 

14.3 In the event of an emergency situation, or government guidance related to the spread of infections coming into operation, Ciné Schools reserves the right to amend any advertised particulars, such as dates, times, or venue, if it is required. Alternatives will be put in place wherever possible. In the event of any cancellations, activities will be rescheduled or will be subject to a change of particulars, such as a move to online format. This clause supersedes all others relating to cancellation in the event of an emergency situation (such as a national emergency). 

 

15.  Safety Rules

15.1 Children should wear appropriate clothing and footwear to participate in sessions.

 

15.2 Children should not bring any nuts or well-known allergens to sessions. 

 

15.3 Where children bring their own food, they should ensure not to share foods with others in case of allergies. We ask that children are not given nuts to bring into our Academies or Studios.

 

15.4 Children must not use mobile phones and/or personal devices to capture images or video recordings of each other. 

 

15.5 Children, along with parents, guardians, siblings or other associates must stay in the authorised areas and should not enter into unauthorised spaces without permission. 

 

15.6 Where participants take medication, they should only bring essential medication to Ciné Schools activities and staff must be notified of any medication upon arrival. 

 

15.7 Any medication brought to activities must be clearly labelled and the participant should be able to administer it themselves, unless Ciné Schools has agreed otherwise prior to participation. 

 

15.8 Parents/guardians must inform Ciné Schools and its staff of any existing injuries, physical, sensory or learning disabilities or medical conditions. All registrations must have any known medical conditions stated and any changes to such information must be notified to Ciné Schools prior to participation. 

 

15.9 If you are unsure whether a participant should take part in any activity please consult with a GP or medical practitioner before enrolment. Ciné Schools may request a certificate or a letter to confirm suitability to take part. 

 

15.10 Participants must wear suitable clothing at all times.

 

15.11 Disclaimer: All Ciné Schools activities are fully insured for Public Liability, however by attending a Ciné Schools activity you do so fully in the knowledge that whilst Ciné Schools will do all that it can to ensure the safety of those it is providing activities for, accidents can happen.  By attending a Ciné Schools course you acknowledge that Ciné Schools nor any of its staff shall be liable for any personal injury or illness not caused by negligence.  Nothing in this disclaimer shall limit or exclude Ciné Schools’s liability where such injury is caused by negligence.

Neither Ciné Schools nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and material may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

18. Data & Copyright 

18.1 All terms and conditions act in accordance with the GDPR 2018 legislation and our GDPR policy. For more details, please see the GDPR/Privacy Policy available at www.cineschools.com

18.2 As part of its activities, Ciné Schools generates an array of creative content, including film and video products, documentary articles, such as behind the scenes images and video content, scripts, images and audio content. Ciné Schools holds the sole copyright for all creative content, media and associated content produced at Clubs and Camps or its events. 

 

18.3 If any copyright does not automatically lie with Ciné Schools, in taking part, you assign reproduction and disclosure rights for the full period of copyright including any renewals and extensions. 

 

18.4 We reserve the right to reproduce or exhibit these articles in public, including online, subject to the image release details contained in our contributor release form which can be found here: https://www.cineschools.com/releaseform

 

18.5 Subject to the image release clauses detailed in the Contributor Release Form (as mentioned above), Ciné Schools and its partners may also use media including photographs, video and sound recordings from workshops and screenings for promotional use including online.

 

19. Media Permissions: Media Capture & Release 

19.1 As part of your booking, you will be asked for your permission to capture and release your child’s image, voice and likeness for the purposes of creative content, as detailed within our Contributor Release Form which can be found on our website at https://www.cineschools.com/releaseform.

 

19.2 We will always seek the consent of parents/guardians for:
a) Children to appear on camera
b) The release of students’ Image, Voice and Likeness within Creative Content, under the terms of the Publishing Policy and these Terms & Conditions
c) Consent to indicate release permissions for different forms of creative content

 

19.3 Where a parent/guardian does not provide consent, that is not a barrier to the child taking part in the Academy or Studios. We will not publish any material featuring the image, voice or likeness in any form, of these individuals, including private channels. Their image should not be captured on camera. If it is captured, it will be deleted prior to inclusion in any creative content intended for publication. This means that they cannot take on an acting role within any film made during the Academy or Studios, however there are many other ways they can take part behind the camera. 

19.4 Parents/guardians should be aware that we share and publish creative content featuring the images, voices and likenesses of students in a range of places, including online and through sharing with third parties, such as film festivals and film education partners. It is the responsibility of parents/guardians to familiarise themselves with the details of the contributor release form. 

 

19.5 In the case of any children who are identified as vulnerable, e.g. looked after children, explicit consent must be given by an appropriate adult in writing for the student to appear on camera and all other conditions in relation to safeguarding must apply.

 

19.6 Ciné Schools will ensure all safeguarding measures designed to protect its students are adhered to in the course of media capture and release. For more information, please refer to the Contributor Release form and the Safeguarding Policy, available at www.cineschools.com

 

19.7 All recordings captured during the production process will be deleted by the Ciné Schools editor upon completion of the final films. Some still imagery from behind the scenes, as well as clips from the published films, may be used for communication and marketing purposes by Ciné Schools ongoing. 20. Policies & Procedures 

20.1 Ciné Schools operates a number of policies and procedures designed to ensure the health, safety and wellbeing of its students, its staff, its partners and members of the public. 

 

20.2 All policies are available online at www.cineschools.com.

20.3 It is expected that all policies and procedures will be in operation throughout Ciné Schools activities.
